1. Eligibility:
The PrizePicks NBA Playoffs $1,000,000 Daily SuperFlex (the “Promotion”) is open only to legal residents of the United States and the District of Columbia, excluding those states where residents are not eligible to use the PrizePicks platform, who are physically located and reside in the United States or District of Columbia at the time of entry. Void in Puerto Rico and where prohibited by law. Must be 19 years of age or older to enter, unless you are an 18-year-old with an already existing PrizePicks account. Must be 21 years of age or older to enter in Arizona and Massachusetts. Employees, directors, and officers, and their immediate families (parent, child, spouse, siblings and respective spouses) and household members of Performance Predictions LLC d/b/a PrizePicks (“Sponsor”) and any respective affiliates, subsidiaries, divisions, paid partners and advertising and promotion agencies are not eligible to enter. The promotion is only open to people who have a valid PrizePicks account and are opted-in.
2. How To Enter
You may enter the Promotion by gameplay only. The selection window opens every day at 10 a.m. ET, and ends when the winner of the day is chosen. To enter the Promotion each day, play $5+ rosters on PrizePicks during the selection window. Placing a valid PrizePicks roster during the selection window earns you one (1) entry into the Promotion. Every roster you place during the selection window earns you an additional entry into the Promotion.
Entry Limits. No facsimiles allowed. Entries that have been generated by a script, macro, bot or any other automated means; or that are mechanically reproduced, copied, illegible, incomplete, postage due, received after the entry period or inaccurate, are void. Entry materials that have been tampered with or altered are void. Incomplete entries or entries not complying with these Official Rules are subject to disqualification, at the Sponsor’s sole discretion. Sponsor is not responsible for lost, stolen, mutilated, undelivered, garbled, damaged, incomplete, illegible or misdirected entries or for malfunctions of electronic equipment, computer hardware or software, or any other technical problems related to website entries or limiting the ability of an individual to participate in the Promotion. Entries and any other materials submitted in connection with the Promotion become property of Sponsor and will not be returned. Any attempt at entry except as above stated is void. Entries received prior to or after the Promotion Period are void. Sponsor’s computer will be the official clock of the Promotion. This Promotion is void in Puerto Rico, the U.S. Virgin Islands, and wherever prohibited or restricted, and is subject to all United States federal, state and local laws. Entrants who enter the Promotion agree to be contacted by Sponsor regarding Sponsor’s products and services.
If a dispute results as to the identity of an online entrant, it will be determined that the online entry was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address.
3. Promotion Period
The Promotion coincides with the published 2023 National Basketball Association (“NBA”) Playoff Schedule (excluding the Play-In Schedule) and will, therefore, begin at 12:00 a.m. ET on April 15, 2023, and end at 11:59 p.m. ET on June 18, 2023 or whenever the final game of the NBA Playoffs Finals is played (the “Promotion Period”), subject to revision at the sole discretion of the NBA and/or PrizePicks.
4. Winner Determination
Prior to the start of the selection window, a random number will be chosen from a number set entered into a random number generator by PrizePicks staff. The upper boundary of the daily number set may fluctuate, at the sole discretion of PrizePicks, based on projected entries for that day. The entry number that matches the random number will be the winning entry for that day. For example, if 50 is the number chosen, the 50th entry placed during that day’s selection window will be the winning entry. The PrizePicks Member who places the winning entry will receive the grand prize, as long as they meet eligibility requirements. After the winning entry is placed, the sponsor will perform a verification check to ensure the Member who placed the entry meets all eligibility [1. ELIGIBILITY] requirements.
If the person who places the winning entry does not claim the grand prize as specified in the section below [5. PRIZE], or does not meet the eligibility criteria outlined in [1. ELIGIBILITY], the person who placed the entry closest in time after the winning entry will be chosen as a replacement. This process will repeat itself for a maximum of three replacements who are deemed eligible. If 3 or more eligible replacements do not claim the prize for that day of the Promotion, the Promotion will end for the day, and an additional winner will be chosen during the next selection window as explained in this Section 4.
5. Prizes
There is one (1) prize available every day of the Promotion Period. The winner will be notified by an official email no later than 30 minutes after the selection. A winner may also be notified by phone, further emails, direct message, push notification, and/or in-app notification. The winner is responsible for compliance with all applicable laws pertaining to acceptance of the prize as well as compliance with all PrizePicks Terms of Service and these Official Rules.
PRIZE - Grand Prize: $40,000 6-Pick Flex Entry (“Prize”). The Prize will pay out according to standard PrizePicks 6-Pick Flex payouts. The winner will receive $1 Million if they correctly choose 6 picks, $80,000 if they correctly choose 5 picks, and $16,000 if they correctly choose 4 picks. All other outcomes, including if one or more picks tie or DNP, will pay according to PrizePicks standard 6-Pick Flex payouts. All winnings will be paid out in credit that can be withdrawn with the help of the Sponsor. All picks in the Prize must be only NBA, NHL, WNBA or MLB full-game picks in action on the day the prize is awarded.
To claim the prize, the potential winner must respond to the official notification email with a signed waiver within one (1) hour of the official notification email being sent. Once the prize is claimed, the Sponsor will upload the Prize into the winner’s PrizePicks account. Once the Prize is uploaded into the winner’s account, the potential winner will have a maximum of one (1) hour to place it. If the potential winner does not claim the prize within the specified time period, the prize or prize notification is returned as undeliverable, the potential winner is not in compliance with these rules, or the entry does not meet outlined requirements of only having full-game NBA/MLB/NHL picks in action on the day of the drawing, that entrant will be disqualified and the Prize will be forfeited, and the replacement process outlined in [4. WINNER DETERMINATION] will commence.
Federal, state, and local taxes and any other costs or expenses relating to the acceptance or use of the prize not specified in these Official Rules are the sole responsibility of the winner. Winner may not substitute, assign or transfer prize, except at Sponsor’s sole discretion. Sponsor reserves the right, at its sole discretion, to substitute a prize (or portion thereof) with one of comparable or greater value. Sponsor is not responsible for lost, unclaimed, or stolen prizes. If the winner is 19 years of age or older but deemed a minor in his/her state or place of residence, the prize will be awarded in the name of a parent or legal guardian.
6. Limitation of Liability
Entrants, by participating, agree that Sponsor and its respective affiliates, subsidiaries, parent corporations, divisions, retailer, local sponsors and advertising and promotion agencies, and all of their respective officers, directors, shareholders, employees, representatives, and agents, and any and all internet servers and access provider(s) (collectively, "Releasees") will have no liability whatsoever for, and shall be released, indemnified, and held harmless by entrants from and against, any liability, for any injuries, claims, actions, losses or damages of any kind, including death or personal injury, to persons or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in this Promotion.
This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, incidental, punitive or consequential or other damages, including any claim for damages related to rights of privacy or defamation; loss of data, income, or profit; loss or damage to property; and claims of third parties. Entrants agree that Releasees have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Promotion or the prize awarded. Without limiting the generality of the foregoing, Releasees do not make any express or implied warranties or representations with respect to any promotional website or related content, and Releasees shall not be liable for the consequences of any interruptions or errors related thereto.
Releasees are not responsible for printing or typographical errors in any Promotion-related materials; for stolen, lost, late, misdirected, damaged, incomplete, illegible, inaccurate, delayed, garbled, or postage-due mail or entries/submissions; or for transactions that are lost, misdirected, or fail to enter into the processing system; or are processed, reported, or transmitted late or incorrectly; or are lost for any reason, including computer, telephonic, paper-transfer, or human error, or electronic, technical, computer, network or telephonic malfunction, damage, error, omission, interruption, defect, deletion, delay in operation or transmission, or any combination thereof, or problems of any kind, whether mechanical, human, or electronic and whether caused by Sponsor, users or any equipment or programming associated with or utilized in the Promotion or by any technical or human error which may damage a user’s system or limit an entrant’s ability to participate in the Promotion. If, for any reason, in Sponsor’s sole opinion, this Promotion is not capable of running as planned, or infection by computer viruses, bugs, or tampering, unauthorized intervention, fraud, actions of entrants, technical failures, or any other causes corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, the Sponsor reserves the right at its sole discretion to award the prize from all eligible, non-suspect entries validly received prior to the action requiring such modification and/or to terminate, modify or suspend the Promotion.
Except where prohibited, this Promotion and the Official Rules and all related claims, questions, and disputes are governed by the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules and, except where prohibited, venue shall be in the appropriate court of competent jurisdiction in Fulton County, Georgia, for the resolution of all claims, questions, and disputes related to the Promotion and the Official Rules.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR ANY ONLINE SERVICE RELATED TO THE PROMOTION OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE PROMO MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of such term or any other provision. Sponsor reserves the right to disqualify any entrant who violates the rules or interferes with the Promotion in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate such entrant’s eligibility to participate in the Promotion. Any attempt by an individual to access any website associated with the Promotion via a bot script or other brute force attack or any other unauthorized means will result in that individual’s IP address becoming ineligible. Use of automated entry devices or programs is prohibited.
7. Participation
By entering, entrants agree to: be bound by these Official Rules including all eligibility requirements and the decisions of the Sponsor, which shall be final in all respects and waive any right to claim ambiguity in these Official Rules. By entering the Promotion each entrant agrees to participate in a video interview with Sponsor if requested by Sponsor. Entrants also grant, where legal, to the Sponsor and its designees permission to use of their names, likeness, address [city and state], image, photograph, voice and biographical material and entry submission and prize information for future advertising, trade, promotional and publicity purposes by Sponsor or their designees, in any and all media now or hereafter known, including but not limited to any online announcements, or for sharing this information with the press for viewing, whether television or print, throughout the world in perpetuity, without additional compensation, notification or permission, except where prohibited by law and, upon request, will provide consent to such use in writing.
Any violation of these Official Rules by entrants will be considered a violation of PrizePicks’ Terms of Service and allow PrizePicks to deactivate the entrant's account, as well as use all other remedies provided for in the Terms of Service.
As a condition of entering the Promotion, entrant agrees that all causes of action arising out of or connected with this Promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action or jury trial. The Sponsor reserves the right to modify prize award procedures. Sponsor will not share this information with any third parties, except as necessary for the administration of the Promotion. Sponsor will collect information from online entrants for the purpose of administering the Promotion and to notify a winner and to contact such entrants in the future with information from the Sponsor and its respective affiliates. Sponsor’s use of information submitted online by entrants in connection with this Promotion will be subject to the terms and conditions stated in these Official Rules.
